Privacy Policy

Last updated: November 2, 2026

This policy supersedes the PerkUp privacy policy dated September 3, 2021. Prior dated versions are available at this address or on request to legal@perkupapp.com.

At a glance

  • PerkUp, Inc. is a Delaware company. Organizations use our platform to run rewards, recognition, gifting, and swag programs: software plus the production and worldwide delivery of physical goods.

  • When your employer, or the Organization that sent you a gift, runs a program on PerkUp, that Organization controls the personal data in it and we process it on the Organization’s behalf under our Data Processing Addendum (the “Data Terms”). Send requests about program data to that Organization, or to legal@perkupapp.com and we route them within five business days.

  • For our website, demo requests, account sign-up, billing, guest store purchases, Personal Funds, and our own marketing, PerkUp decides how data is used and this policy applies in full.

  • We collect what is needed to run accounts and deliver orders: contact details, delivery addresses, order contents and sizes, and, only where a destination country requires it to clear or invoice a shipment, a local tax or customs identification number.

  • We do not sell personal information and we do not share it for cross-context behavioral advertising. Our website and product carry no advertising or remarketing tags, and Google Analytics runs with Google signals and advertising features turned off (Section 6.8).

  • We never send PerkUp marketing to Members, Recipients, or store shoppers because they received a reward or bought something, and we never let anyone else use their details for marketing. The one exception is an Organization you have given marketing consent on its own event form (Section 3.5).

  • The AI features in our product operate on product and logistics data, not on personal data, and we never use customer data to train, fine-tune, or improve generative AI models (Section 5).

  • Product analytics and session replay are used for service quality, support, and security, never for advertising; session replay records what appears on your screen and what you type into forms, except passwords (Section 7.2).

  • Questions and requests: legal@perkupapp.com.

1. Who we are and what this policy covers

1.1. PerkUp. PerkUp, Inc. (“PerkUp”, “we”, “us”, “our”) is a Delaware corporation with offices at 651 N Broad St, Suite 206, Middletown, DE 19709, USA. We provide an employee rewards, recognition, gifting, and swag platform, including swag stores, redemption pages, ordering, and fulfillment of physical goods (the “Platform” and the “Services”; “Organization”, “Member”, and “Recipient” have the meanings our Terms of Use give them).

1.2. Scope. This policy explains how PerkUp handles personal data when we decide why and how it is processed, that is, when we act as a “controller” or “business” under privacy law. It is referenced across our surfaces: our public website at perkupapp.com (tryperkup.com is a legacy domain that redirects there), the product application at my.perkupapp.com, our help center, hosted swag stores and redemption pages (including stores we serve on an Organization’s own domain), our demo and sign-up forms, and our emails and support channels. Section 2 explains which data on those surfaces PerkUp controls and which it processes on an Organization’s behalf. This policy does not cover the personal data of PerkUp’s own employees, contractors, and job applicants.

1.3. The rest of our legal stack. This policy works alongside our Terms of Use (perkupapp.com/legal/terms-of-use), the PerkUp Master Services Agreement, the “Master Services Terms” (perkupapp.com/legal/msa), the PerkUp Data Processing Addendum, the “Data Terms” (perkupapp.com/legal/dpa), our sub-processor list (perkupapp.com/legal/data-subprocessors), and our security overview (perkupapp.com/legal/security). Section 7 of this policy is our cookie notice.

1.4. This policy does not modify agreements. Where an Organization has an agreement with PerkUp, that agreement and its Data Terms, including any timelines an executed data processing addendum sets, govern our processing of the Organization’s program data and prevail over this policy for that data. Nothing in this policy gives PerkUp rights over customer data beyond what those documents allow.

1.5. “Program data”. In this policy, “program data” means the Customer Data (as the Master Services Terms define it) that an Organization and its people provide or generate in its programs, including Member and Recipient personal data; “customer data” has the same meaning.

2. Our two roles: processor and controller

2.1. For program data, your Organization is the controller and PerkUp is its processor. Where PerkUp processes Member and Recipient personal data to run an Organization’s programs, the Organization is the data controller (or, where it runs programs for its own clients, their processor), and PerkUp processes that data on the Organization’s behalf, on its documented instructions, under the Data Terms. The Data Terms apply to every Organization account: through a signed agreement, or through our Terms of Use for Organizations using PerkUp self-serve (Terms of Use, Section 3.3). Organizations are responsible for having a lawful basis for, and giving notice of, the Member and Recipient data they provide to us, including addresses synced from an HR system.

2.2. The routing rule. The Organization that runs your program decides what data the program uses and answers privacy requests about it: access, correction, deletion. You can contact that Organization directly, or send your request to legal@perkupapp.com and we will route it: if a request submitted to us identifies the Organization, we forward it to the Organization within five business days and assist it in responding, as the Data Terms require.

2.3. Where PerkUp is the controller. We are the controller, and every section of this policy applies directly, for:

  • visitors to our public website;

  • demo requests and sales inquiries;

  • the business-contact, account, contract, and billing records of the people who sign up for, administer, and pay for an Organization’s account, for the account, billing, and contract relationship itself (what administrators do inside the Organization’s programs, including in-app support conversations about those programs, is processed for the Organization under Section 2.1);

  • guest purchases in swag stores, and Personal Funds you load from your own payment method (Terms of Use, Section 6.2);

  • PerkUp’s own marketing, vendor, and business contacts.

2.4. Carriers and customs authorities that receive delivery data act as independent controllers of that data (Section 6.3).

2.5. Our legitimate-interest and consent bases (Section 4.4) apply only where PerkUp is the controller. Program data is processed on the Organization’s instructions and legal bases, never on a legal basis of our own.

3. Personal information we collect

What we collect depends on how you interact with PerkUp. For Members, Recipients, and administrators acting within an Organization’s program, we hold the data below as that Organization’s processor (Section 2), while PerkUp controls the account, billing, and contract relationship with the Organization (Section 2.3).

3.1. Website visitors. Device and browser data, pages viewed, approximate location inferred from your IP address, and analytics events (including form submissions), collected through the cookies and tools described in Section 7.1, which also describes the support chat widget on our site.

3.2. Demo requests and business contacts. When you request a demo, we collect your work email and anything else you submit through our form-handling provider, and the form records the campaign parameters in the link you arrived from (for example utm_source) so we know which campaign brought you. We store these details in our CRM to respond, schedule, and follow up. For billing, vendor, and partner contacts, we hold names, business contact details, and correspondence. We may also obtain business contact details from publicly available professional sources, such as company websites and LinkedIn. When we first contact you, and in any event within one month of obtaining your details, we point you to this policy, which tells you that your details came from such a source; you can object to further contact at any time by replying or emailing legal@perkupapp.com, and we then stop and delete the record.

3.3. Customer administrators. Account and profile data (name, email, profile picture), Organization settings, roles and permissions, billing records, support conversations, and product usage data (Section 7). Payment-card details are collected directly by Stripe, our payment processor; PerkUp does not store cardholder data and retains only payment tokens and non-sensitive payment metadata, such as card brand, last four digits, and expiration date. When an administrator or sender searches for a GIF or stock image for a reward, template, or redemption page, their browser sends the search terms to Giphy or Unsplash under those providers’ privacy policies.

3.4. Members. When an Organization invites or provisions you, we process:

  • identity and contact data: name, work and (where provided) personal email, phone, profile photo;

  • employment attributes your Organization syncs from its HRIS or directory: title, department, manager, location, start and end dates, employee ID, employment status, and leave-of-absence information, including any employer-assigned labels (custom fields the Organization chooses to sync);

  • your date of birth and start date, which your Organization’s HRIS synchronization includes unless the Organization turns it off, or which it uploads by file, used for birthday and anniversary programs;

  • if you request a prepaid card, your date of birth and the IP address of your request, which the card issuer requires; we keep a copy of the cardholder record for the life of the card program and as financial-record law requires (Section 6.5);

  • where your Organization connects Slack: the workspace member list (names, usernames, and emails), which we read to match you to your account, your Slack username, the messages we send you there, and your notification preferences;

  • reward, order, redemption, and balance data (for Personal Funds you load from your own payment method, PerkUp is the controller, Section 2.3);

  • shipping addresses you save, or, where your Organization enables it, a home address synced from its HR system;

  • messages you write (recognition posts, gift notes) and images or designs you upload.

Much of this comes from your employer rather than from you: email invitations, roster imports, HRIS synchronization, single sign-on and directory sync, and workspace tools your Organization connects. How we treat what those systems send:

  • HRIS synchronization writes only the fields your Organization has chosen to sync; sensitive field names are blocked, and custom fields require an allow-list. If your HRIS supplies a preferred name, we use it as your display name. Other attributes your HRIS transmits in its responses, such as gender, are not mapped to your profile or used for any purpose.

  • Directory sync through your identity provider maps your employee ID, division, department, cost center, subsidiary, region, executive flag, country, employment type, leave dates and type and, where your Organization configures it, a shipping address into your profile and its labels. We keep the directory record your identity provider sends, including attributes we do not map, so we can reconcile changes; it is stored with your Member record and deleted with it (Section 8.2).

3.5. Gift recipients, store shoppers, and other people without accounts.

  • When an Organization sends you a gift or reward, we email or message you on its behalf so you can claim it, choose options, and confirm or enter your delivery address. If you claim it through a reward link or redemption page, we collect the email, name, shipping address, phone number, and product choices (such as size) you enter, plus any gift message addressed to you. You can stop reminder emails using the link in the message; an unclaimed reward returns to your Organization under its program rules. If you never claim a gift, we keep the contact details the sender gave us only as long as the Organization’s program needs them, and delete them under Section 8.

  • Where the destination country requires it to clear or invoice a shipment, we collect a customs or tax identification number with your delivery details: a Brazil CPF or CNPJ, China Resident ID, Korea PCCC, or Mexico RFC. We ask for it only on the delivery form for that country and use it solely to clear or invoice your shipment. It is stored with the delivery address it belongs to, is never used for anything else, and is deleted with that address or with your account or program data under Section 8.

  • If you buy in a hosted swag store as a guest, we collect your name, shipping address, email, and order details; your payment card goes directly to Stripe. Guest shoppers receive only order and delivery messages.

  • If you play a game at an Organization’s event, we collect, on the Organization’s behalf and under the notice it shows you, the name and email you enter, a shipping address if you win a physical prize, your marketing-consent choice, and a hashed form of your IP address kept with the draw record to detect abuse and audit the result; the Organization decides how long it keeps entries. Where PerkUp itself offers a prize, discount, or gift in exchange for your contact details, that is a financial incentive under California law. You opt in by entering your details on the game or offer form; you may withdraw at any time by emailing legal@perkupapp.com, and we then delete your entry. We estimate the value of your contact details at the retail cost of the prize or discount offered, because that cost is what we spend to obtain them and we do not sell or otherwise monetize them; that estimate is the basis for the incentive.

  • When you type an address in the product, your browser sends it to our address-autocomplete provider (currently Mapbox) to suggest and validate it. We also send an Organization’s business address to Google to geocode it and set the Organization’s time zone.

  • Where your Organization imports your contact details from its CRM, calendar, or form tools (Section 6.4), we receive the fields it maps and may write reward status back to its record of you at its direction.

  • The notices we email you report delivery and engagement events (delivered, bounced, opened, clicked) back to us so we can troubleshoot them, and once your reward link is validated on a redemption page we label the session-replay recording with the email and name on the reward so support can find your session (Section 7.2).

3.6. Where data comes from. Directly from you; from your Organization or the gift sender (including the HRIS, directory, single sign-on, workspace, CRM, calendar, and form systems it connects, Section 6.4); automatically from your device and your use of the Services (Section 7); and from our service providers, such as payment status from Stripe and delivery events from carriers and tracking providers.

3.7. Sensitive data. The Services do not require, and we do not request, special categories of personal data (such as health, biometric, or religious data), payment-card numbers (Stripe collects those directly), or government-issued identification numbers, except the customs or tax identifiers described in Section 3.5. Sensitive information may appear incidentally in free text (for example, a recognition message) or in HRIS fields an employer configures; we do not use it for any other purpose, and we never sell it. Where a privacy law requires opt-in consent to process sensitive personal data, we obtain that consent or do not process the data. The Services are not designed to process protected health information, and PerkUp does not act as a HIPAA business associate; Organizations should not configure programs that require it.

4. How we use personal information

4.1. Where PerkUp is the controller, we use personal data only as needed to:

  • provide, maintain, secure, and support the website and the Services;

  • create and administer accounts, balances, and Personal Funds;

  • process payments and refunds through Stripe, a PCI-DSS Level 1 certified payment processor;

  • produce, fulfill, ship, deliver, and support orders;

  • send service communications: order, delivery, account, and reward notices; reminder emails include an unsubscribe link, and opting out of reminders does not affect transactional notices about your orders and account;

  • respond to demo requests and provide support;

  • send PerkUp marketing, product news and offers, to the business contacts who evaluate, administer, or pay for PerkUp for an Organization and to prospects who contacted us, with an opt-out in every message; we never market to Members, Recipients, or store shoppers because they received a reward or gift or bought something;

  • prevent fraud and abuse, enforce our terms, and keep the Platform secure;

  • comply with law, including tax and financial record-keeping, economic-sanctions and export-control restrictions on where and to whom we ship, and unclaimed-property (escheat) handling of balances we cannot return;

  • create aggregated and de-identified data (Section 4.3).

By purpose, the categories involved are: providing and supporting the Services (identifiers, account and profile data, commercial information, device and usage data); fulfilling and delivering orders (identifiers, delivery details, order contents and sizing, customs or tax identifiers where required); payments (payment tokens and billing records); security and fraud prevention (identifiers, device and usage data); marketing to business contacts (business contact details). None of these purposes involves sale, targeted advertising, or profiling with legal or similarly significant effects.

4.2. Program data is used more narrowly. Member and Recipient data in an Organization’s program is processed only on the Organization’s documented instructions: to provide, maintain, secure, and support the Services; to produce, fulfill, ship, and deliver orders and rewards; to send service communications and provide customer support; and to create aggregated and de-identified data as our agreements permit. We do not use program data for PerkUp’s own marketing or advertising, we do not send Member or Recipient identities to marketing tools, and we do not combine program data with personal information from other sources except to deliver the Services, for example matching a carrier’s delivery scan or a payment confirmation to your order.

4.3. Aggregated and de-identified data. We may create and use data in aggregated or de-identified form (form that identifies neither a customer nor any individual) to improve and enhance the Services and for development, diagnostic, and corrective purposes: understanding how the Services and the catalog are used, planning production and shipping capacity, and testing and fixing the Services. We take reasonable measures to ensure it cannot be associated with any individual or household, maintain and use it only in de-identified form, never attempt to re-identify it, and contractually require the same of anyone who receives it; this policy is our public commitment to do so (Cal. Civ. Code § 1798.140(m)). We do not sell or license aggregated or de-identified data, we do not publish it in a form that identifies a customer, and we never use it to train generative AI models (Section 5).

4.4. Legal bases (EEA, UK, and similar laws). Where the GDPR or UK GDPR applies to processing PerkUp controls, the legal basis for each purpose is:

  • Accounts, Personal Funds, purchases, deliveries, refunds, and the order and account notices that go with them: performance of a contract with you.

  • Website and product security, fraud prevention, and the support telemetry on the surfaces we control (Section 7.2): our legitimate interests in keeping the Services secure and working, subject to your right to object. Telemetry about Members and Recipients inside an Organization’s program is processed for that Organization as its processor.

  • Website analytics and the support chat widget: consent where law requires it (Section 7.1), otherwise our legitimate interests in operating and improving our website.

  • Marketing to business contacts: our legitimate interests in promoting our services to the businesses that evaluate or buy them, or consent where law requires it, always with an opt-out in every message.

  • Tax, financial, sanctions, and unclaimed-property records, and responses to lawful requests: legal obligation.

You can withdraw consent at any time without affecting processing that already happened.

5. Artificial intelligence

5.1. PerkUp uses generative AI for product-catalog enrichment and content generation: categorizing catalog products, describing them, analyzing product images and imprint placement, estimating package sizes, and generating product mockups with an Organization’s logo. These features operate on product, design, and logistics data: supplier product images, titles, and descriptions, and the product names, categories, and logos administrators supply, not on personal data. The providers of these AI capabilities are currently Anthropic and Google (Gemini models run through Vertex AI inside our own Google Cloud environment); they are identified as AI providers, with the features they serve, on our sub-processor list at perkupapp.com/legal/data-subprocessors. Supplier product text is translated with Google Cloud Translation, a machine-translation service rather than a generative model. Our staff may also use enterprise AI assistants for internal work under terms that prohibit the provider from training on our data and under an internal acceptable-use policy; those tools are not integrated with the Platform.

5.2. Our AI features do not send personal data to those AI providers. We do not collect, use, or sell any personal data, whether we control it or process it for an Organization, to train large language models or any other generative artificial-intelligence or foundation model. We do not use customer data, including personal data and the inputs to and outputs of our AI-assisted features, to train, fine-tune, or improve any such model, and this commitment extends to aggregated and de-identified data derived from customer data. Our AI providers are contractually prohibited from using customer data to train their models. These commitments are stated in the Data Terms (perkupapp.com/legal/dpa).

5.3. We do not use automated decision-making, AI-driven or otherwise, that produces legal or similarly significant effects concerning you, such as decisions about employment, credit, housing, or insurance. This includes decisions made or substantially informed by computer programs as described in Australian Privacy Principle 1.7; we make none that significantly affect your rights or interests.

6. How we share personal information

6.1. Service providers (sub-processors).

  • What they do. We use a limited set of vendors to run the Platform: cloud hosting, payments, email and notification delivery, support tooling, product analytics and session replay, in-app search, address autocomplete, HRIS and sign-on connectivity, data imports, marketplace and gift-card ordering, storefront and on-demand production connectivity (Shopify receives the order and delivery details of the on-demand orders routed through it), reporting, shipping labels and delivery tracking, and AI capabilities (which receive no personal data, Section 5). Each processes personal data only to provide its service to us, under contract.

  • Search. Our product-catalog search provider receives catalog data only. The search provider that powers the Member directory (Typesense) indexes each Member’s record so administrators can search their roster and see upcoming birthdays and work anniversaries.

  • Where the list is. The sub-processors that process personal data on our customers’ behalf, their purposes, and their locations are published at perkupapp.com/legal/data-subprocessors, which we maintain as the Data Terms describe. We give Organizations at least 30 days’ notice before a new sub-processor processes personal data (except for urgent replacements, where we give the most notice circumstances allow), and they may object as the Data Terms describe; to receive change notices, email legal@perkupapp.com with the subject “Subprocessor updates”.

  • Website-only providers. Providers that serve only our public website (site hosting, web analytics, the support chat widget, form handling, and cookie-consent tooling) are described in Section 7.1 rather than on that page.

  • Our internal tools. Our collaboration, ticketing, and shared-inbox tools (Slack, Linear, Front, and Google Workspace) may process the business contact details of your administrators, and the name and email on an order or reward, when we fulfill an order or answer a request.

6.2. Fulfillment and delivery. To deliver physical goods, we collect the recipient’s name, shipping address, and contact details, any identifiers destination-country customs or tax rules require, and the order details (contents, sizing, and personalization) needed to produce and clear the shipment, and we share them with production suppliers, fulfillment and warehousing partners, carriers, customs brokers, and customs authorities as needed to produce, clear, deliver, and support the order.

6.3. Carriers and customs authorities are independent controllers. Carriers, postal operators, and customs authorities process delivery data under their own terms of carriage, tariffs, and legal obligations. They determine their own purposes and means, so they receive that data as independent controllers, not as our service providers.

6.4. Your Organization, and the tools it connects.

  • Who in your Organization sees what. Your Organization assigns platform roles. Its administrators, and anyone it gives the manager role (an Organization-wide role, not limited to your own manager), can see the Member profile your Organization syncs or enters (name, work email, title, department, start date, employer-assigned labels, and, where your Organization syncs them, date of birth and leave status), program participation, recognition and reward activity, orders placed in the Organization’s programs (including the delivery address on each order), and spending from balances the Organization funds. Addresses you save in your own account are visible only to you and appear on the orders you place; addresses your Organization syncs from HR or enters for you are visible to administrators only, never to managers. Personal Funds transactions are visible only to you.

  • Your settings. In your account settings you can hide your birthday or anniversary from administrators, managers, or other Members.

  • Your Organization’s own use. Your Organization may use reward and redemption records for its own purposes, such as payroll and taxable-benefit reporting, under its own privacy notice. Senders may use recipient addresses and contact details obtained through the Platform only to send the gifts and rewards they were provided for.

  • Connected tools. Where your Organization connects a third-party tool (an HRIS, an identity provider, Slack or another workspace tool, a CRM, or a scheduling or form tool), personal data flows to and from that tool at the Organization’s direction (for example, we write reward status back to the CRM record of a recipient), and the Organization’s agreement with that tool governs its processing.

6.5. Issuers, banks, and marketplaces. Gift cards and vouchers are issued by third-party issuers under the issuer’s terms, and prepaid cards are issued by a partner bank through our payment processor under the issuer’s cardholder agreement and privacy notice, which we present when you request a card; these issuers are independent of PerkUp. Marketplace and gift-card providers we order through on your Organization’s behalf, including Amazon Business, Xoxoday (Plum), and any marketplace-ordering service we use to place orders with other retailers, are our sub-processors and receive only the name, address, phone, or email needed to deliver the item or code.

6.6. Legal and safety. We disclose personal data where law requires it and, for data PerkUp controls, to enforce our agreements or to protect PerkUp, our users, or the public; for an Organization’s program data, we disclose only as the Data Terms and the Organization’s instructions allow or as law requires. For government and law-enforcement requests, we review the legality of each request, work to resist or narrow any request we conclude is unlawful or over-broad, disclose only the minimum required, and, unless legally prohibited, notify the affected customer before disclosing its program data. We have not created, and will not create, back doors or similar programmatic access for any government.

6.7. Corporate transactions. If PerkUp is involved in a merger, acquisition, financing, or sale of assets, personal data may be transferred as part of that transaction, subject to this policy’s protections, and we will notify you of a transfer that changes who is responsible for your data.

6.8. No sale, no ad sharing. We do not sell personal information, and we do not share it for cross-context behavioral advertising, not for money and not for other consideration. Our 2021 privacy policy described interest-based advertising on our websites; we have discontinued it. Our website and product carry no third-party advertising pixels or remarketing tags, Google Analytics runs with Google signals and all advertising features turned off, and we re-verify both surfaces for advertising technologies before each update of this policy. If we ever introduce advertising or remarketing technologies, we will update this policy and offer an opt-out, including a “Your Privacy Choices” link and Global Privacy Control support, before they run. We have no actual knowledge of selling or sharing the personal information of consumers under 16, and we do not disclose personal information to third parties for their own direct marketing purposes (Cal. Civ. Code § 1798.83).

7. Cookies, analytics, and similar technologies

This Section is our cookie notice, and the table in Section 7.2 is the complete list of the cookies and similar identifiers we set.

7.1. Marketing site (perkupapp.com). The site uses Google Analytics 4 to measure visits, page views, and demo-form submissions; Google signals and all Google advertising features are turned off, and no advertising or remarketing tags run on the site. Google Analytics sets the _ga and _ga_<id> cookies. The site loads the Atlas support chat widget on every page; when it loads it assigns your browser a visitor identifier and may start an automated assistant, and if you chat it receives the messages and contact details you provide. We do not use it to record your browsing session. Our demo form is handled by Formspark, and our site host, Framer, collects its own visit analytics without cookies or persistent identifiers. A cookie banner from our consent provider, CookieYes, lets you accept, reject, or customize non-essential cookies by purpose; a privacy-preferences button on every page lets you change your choice at any time; and CookieYes keeps a record of each choice (a random consent ID, the date, your country, and what you chose). If you are in the EEA, the UK, Switzerland, or Canada, Google Analytics and the chat widget do not load, and set no cookies, until you accept the relevant purpose; elsewhere they load when the page does, and the same button turns them off.

7.2. Product application. When you use the PerkUp app, with or without an account, including redemption pages and hosted swag stores, we and our providers collect usage data (tied to your account where you have one): identifiers such as an internal user ID, your name, email, Organization, role, and job title, together with the pages and actions you take, your IP address and device and browser data, and the country our edge network derives from your IP address to pre-select your region. Our product analytics tools do not receive your date of birth, leave information, or home address as part of your profile; session replay records what appears on screen, as described below.

  • Product analytics (Segment, and Google Analytics for Firebase, a property separate from the marketing site): which features are used and where they fail, so we can support you, keep the Services secure, and fix problems; product improvement uses the aggregated data described in Section 4.3. Once you sign in, both receive your account identifier, name, email, and role with your usage events, and Segment also receives your job title, your Organization, your balance, and your employer-assigned labels. Segment loads only after you sign in; Google Analytics for Firebase also measures pages you open without signing in.

  • Session replay (LogRocket): a reconstruction of the screens used in a session, including the text shown on screen, what you type into forms, and the app’s network activity, which we use to diagnose bugs, assist support, and investigate security issues. Passwords are masked in your browser before anything is sent, and credentials and tokens are removed from recorded network traffic and page addresses. Replay stores a pseudonymous identifier in your browser and is linked to your account and email once you sign in; on a redemption page it is labeled with the email and name on the reward once your link is validated. Our replay provider keeps recordings for 30 days and then deletes them.

  • Support messenger (Intercom): the chat widget loads on app pages, including redemption pages and before you sign in, and sets its own cookies; when you sign in we tell Intercom who you are (name, email, Organization, role, and job title) so support can see your account, and your conversations are stored there. Our help center is hosted by Intercom and sets its cookies when you visit.

  • Email delivery events: our email providers report delivery and engagement events (delivered, bounced, opened, clicked) for the notices we send, including to Recipients without accounts, so we can troubleshoot them.

  • Hosted swag stores, including stores on an Organization’s own domain: a strictly necessary session cookie (__Host-perkup_store_session, 24 hours) keeps you signed in, and session replay runs as described above; stores do not load the support messenger or Google Analytics.

  • Browser storage: we also use your browser’s local storage and IndexedDB for sign-in, carts, drafts, and preferences; they hold no payment data.

  • Server logs: our servers record the IP address and browser of each request for security and troubleshooting; request logs are kept for 90 days.

This telemetry is collected for service quality, support, and security, never for advertising. It starts when the app loads, including on the sign-in page and on pages you use without an account, and Section 7.3 gives you ways to limit or object to it. Inside an Organization’s program this telemetry is part of the Services and processed on the Organization’s instructions under the Data Terms (Annex I). On the surfaces PerkUp controls, we rely on the legal bases in Section 4.4.

7.3. Your choices. On our website, set your cookie choices in the banner and change them any time via the privacy-preferences button. In the product application, you can block or delete cookies and site data in your browser settings, block Google Analytics with Google’s opt-out browser add-on, or object to the telemetry by emailing legal@perkupapp.com (Sections 11.2 and 11.5); if you are a Member, your Organization can instruct us in writing to turn off session replay and product analytics for its workspace, and we do. Strictly necessary cookies that the Services need to function do not have an off switch.

7.4. Global Privacy Control and Do Not Track. We treat a Global Privacy Control (GPC) signal as a valid request to opt out of the sale and sharing of personal information and of processing for targeted advertising. You can send one by using a browser or extension that supports it (see globalprivacycontrol.org). We process the signal in a frictionless manner: we do not charge you, ask you to confirm, or change your experience, and because we do not sell personal information, share it for cross-context behavioral advertising, or process it for targeted advertising (Sections 6.8 and 11.3), there is nothing further for the signal to switch off; if you are signed in, the signal is honored for your account as well as your browser. We make no offline sales, so there is nothing offline for the signal to reach. We treat legacy Do Not Track signals the same way.

8. How long we keep personal information

8.1. We keep personal data only as long as needed for the purposes in this policy, based on the following criteria: the life of your account or of our relationship with your Organization; the lifecycle of an order (production, delivery, support, warranty, and reorders); our legal obligations (tax and financial records, and unclaimed-property law for balances we cannot return); and the resolution of disputes. Operational telemetry runs on shorter cycles: raw change logs for our catalog and fulfillment tables in our analytics mirror are trimmed on cycles of 7 to 90 days, session recordings are kept by our replay provider for 30 days, session-replay export staging is deleted after 30 days, server request logs are kept for 90 days, and aggregated engagement reporting uses a trailing 365-day window. Copies of account data in our analytics mirror are kept for the life of the account relationship and are deleted with the account data under Section 8.2.

8.2. Program data follows the Data Terms. When an Organization’s agreement ends, its data remains available for export for 30 days. The Organization may request deletion in writing at any time after termination, and we complete the requested deletion from our production systems, which include our primary databases and the analytics and search stores derived from them, within 30 days of the request under our standard Data Terms, and certify it in writing on request. Absent a request, we delete program data in the ordinary course under our standard retention schedule after the 30-day retrieval period, and we describe that schedule and our maximum backup rotation on request. When your Organization removes you from its roster, your profile is kept as a removed record in the Organization’s data until the Organization deletes it or asks us to; an Organization can instruct us to delete Member or Recipient records at any time. Personal data remaining in backups is not used for active processing and is deleted or overwritten as backup copies expire on rotation; we restore backups only for disaster recovery or where law requires, and delete personal data so restored. We may retain data that law requires us to retain, and aggregated or de-identified data (Section 4.3).

8.3. Financial records. Records of payments, balances, and Personal Funds are kept as financial-record and unclaimed-property law requires. Personal Funds themselves never expire and remain refundable as the Terms of Use describe; balances we cannot return are delivered to the authority unclaimed-property law directs, never kept by PerkUp.

9. Security

9.1. PerkUp maintains an information-security program audited annually under SOC 2 Type II. Its measures include encryption in transit (TLS 1.2+) and at rest, application-layer encryption for high-sensitivity tokens, role-based least-privilege access with tenant isolation enforced at the database rule layer, multi-factor authentication for PerkUp staff access and step-up re-authentication for sensitive administrative operations (customer single sign-on applies your identity provider’s MFA policy), annual third-party penetration testing, backups and point-in-time recovery of production data, and keeping production data out of development and test environments. An overview is published at perkupapp.com/legal/security.

9.2. Authorized PerkUp personnel access account data only as needed to provide support, operate the Services, and investigate abuse, on a need-to-know basis, under access controls, with privileged access logged.

9.3. No system is perfectly secure, and we do not promise ours is. If we confirm a security incident affecting personal data, we notify affected Organizations in writing without undue delay and, under our standard Data Terms, in any event within 72 hours of confirming it, with what we know at the time and phased updates as our investigation progresses; an Organization’s executed agreement may set a shorter period. We notify individuals and authorities where law requires us to; for program data, the Organization controls notifications to its own people. Report security concerns to security@perkupapp.com.

10. International transfers

10.1. We process personal data primarily in the United States, on Google Cloud Platform; we do not currently offer EU or UK data hosting. Our sub-processors operate in the locations stated on the sub-processor list. Delivery details for an order (the recipient’s name, address, contact details, order contents, and any customs or tax identifier the destination requires) travel only to the production and destination regions that order routes through, including Canada, Mexico, the USA, Brazil, the UK, the European Union (including Spain, Latvia, and Lithuania, where our EU production and warehousing partners operate), Switzerland, the UAE, India, Australia, New Zealand, China, and Hong Kong, and any other country where a supplier produces the item ordered. Apart from the sub-processors on our list, no other program data leaves our United States environment.

10.2. The United States is not covered by an EU, UK, or Swiss adequacy decision except for organizations certified under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions, and PerkUp is not currently certified. For program data, the transfer mechanism is set out in the Data Terms: an adequacy decision where one applies; otherwise the EU Standard Contractual Clauses (Commission Implementing Decision (EU) 2021/914), with the UK International Data Transfer Addendum (version B1.0) for transfers subject to UK law and the FADP adaptations for Switzerland. For data PerkUp controls, we rely on the Standard Contractual Clauses in our agreements with the service providers that receive it. You may request a copy of the relevant safeguards (with commercial terms removed), and Organizations may request our transfer-impact-assessment information and the production, fulfillment, and customs entities (and their locations) involved in their orders, at legal@perkupapp.com.

11. Your rights and choices

11.1. Who answers your request. For personal data in an employer- or sender-run program, the routing rule in Section 2.2 applies: the Organization decides, and we assist it. For data PerkUp controls (Section 2.3), the rights below apply directly against PerkUp.

11.2. How to exercise your rights.

  • How to ask. Email legal@perkupapp.com or write to the address in Section 14. You can also review and update much of your profile, contact, and delivery information directly in your account, and close your account by contacting help@perkupapp.com or legal@perkupapp.com. Requests are free of charge, except that where a request is manifestly unfounded or excessive we may charge a reasonable fee or decline it where applicable law allows, and we will explain why.

  • Verification. We verify requests using the email address and account information we already hold, and may ask for more information where reasonably needed to verify you. An authorized agent may submit a request with your written permission; we may still confirm the request with you directly.

  • Timelines. We respond within the time applicable law requires: within one month for requests under the GDPR or UK GDPR, extendable by two further months for complex or numerous requests (if we need to ask you to clarify a UK request, the period pauses until you reply); and within 45 days under US state privacy laws, extendable once by a further 45 days where the law allows. We will tell you if we need an extension.

  • No retaliation. You have the right not to be retaliated against for exercising your privacy rights, and we never deny you services, charge you a different price, or provide a different level of service because you exercised them.

  • Complaints. If you are unhappy with how we handle your personal data, complain to us by email at legal@perkupapp.com, through the in-app support messenger, or by post to the address in Section 14. We acknowledge complaints within 30 days of receipt, investigate them without undue delay, and tell you the outcome and the steps we took. You may also complain to the supervisory authority where you live or work, including the UK Information Commissioner’s Office (ico.org.uk), the Office of the Australian Information Commissioner (oaic.gov.au), or the authorities named in Section 11.6.

11.3. United States state privacy rights. If you live in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, or another state with a comprehensive privacy law, you may have the right to: confirm whether we process your personal data and access it; obtain a portable copy; correct it; delete it; and opt out of its sale, of targeted advertising, and of profiling that produces legal or similarly significant effects. We do not sell personal data, do not process it for targeted advertising, and do not carry out such profiling, so there is nothing to opt out of, and we honor Global Privacy Control signals as Section 7.4 describes. We do not use automated decision-making technology for significant decisions, so rights to access or opt out of such technology do not arise.

If you live in Oregon or Minnesota you may request the specific third parties, and if you live in Delaware or Maryland the categories of third parties, to which your personal data has been disclosed: our sub-processor list identifies our service providers by name or category, and on request we provide the specific third parties, including the production, fulfillment, and customs partners that handled your order. Minnesota residents may also question the result of any profiling used in a decision that produces legal or similarly significant effects, learn the reason for it, review the personal data used, and have inaccurate data corrected and the decision re-evaluated; we make no such decisions (Section 5.3). Connecticut residents may request a list of third parties to which we have sold their data; we sell none. Connecticut law also requires us to say whether we use personal data to train large language models: we do not (Section 5.2). Rhode Island residents: we have not sold, and do not sell, personal data to any third party, so there is no third party to identify. Nevada residents: we do not sell covered information as defined in NRS 603A.

If we decline your request, you may appeal by replying to our response or emailing legal@perkupapp.com with the subject “Privacy appeal”; we decide appeals within 45 days and explain why. If your appeal is unsuccessful, you may contact your state Attorney General, and our appeal decision tells you how.

11.4. California notice at collection. In the 12 months preceding the effective date, we collected the categories of personal information below, from the listed sources, for the listed business purposes, and disclosed them for business purposes to the recipients shown. We did not sell personal information, and we did not share any category for cross-context behavioral advertising. We use sensitive personal information only for purposes California law permits without an opt-out, authentication and performing the services requested (customs clearance), so the right to limit its use does not apply.

We do not collect biometric information or precise geolocation, we do not draw inferences about individuals, and we do not request or intentionally collect health or education information, though free text and HRIS fields your employer configures (such as a leave type) may include such information incidentally (Section 3.7). We analyze account engagement at the Organization level, how actively a customer uses the Services, to operate and support it; we do not score individual Members, and we do not use inferences to make decisions with legal or similarly significant effects (Section 5.3). For personal information processed in a customer’s program, PerkUp acts as a “service provider” under the CCPA, subject to the restrictions in the Data Terms. The privacy links on our forms point to this policy, and this Section is our notice at collection.

11.5. EEA, United Kingdom, and Switzerland. Where PerkUp controls your data, you may: access it and obtain a copy; rectify it; erase it; restrict or object to its processing, including objecting to direct marketing, which we always honor; receive it in a portable format; and withdraw consent at any time without affecting prior processing. Section 4.4 lists our legal bases; where we rely on legitimate interests, you may object based on your particular situation. You are never under a statutory obligation to provide personal data to us. Delivery details, payment information, and any customs or tax identifier a destination requires are contractually necessary to form and perform a purchase or delivery: without them we cannot complete the order. Everything else is optional. Where your data reached us from your employer rather than from you (Section 3.4), your employer is its source, and usually its controller, so requests about program data are for the employer to answer, with our assistance. You may lodge a complaint with the supervisory authority where you live or work, or where the issue occurred; in the UK that is the Information Commissioner’s Office. Our contact details are in Section 14.

11.6. Canada. Where PIPEDA or Quebec’s Act respecting the protection of personal information in the private sector applies, you may request access to and correction of your personal information and withdraw consent, subject to legal and contractual restrictions; Quebec residents may also request the computerized personal information they provided to us in a structured, commonly used technological format. Personal information is processed outside Canada, primarily in the United States and the locations in Section 10, and may be accessible to authorities there under local law. We do not make decisions about you based exclusively on automated processing. Some technologies in Section 7 include functions that can identify you (product analytics, session replay, and the support messenger once you sign in) or locate you approximately (the country derived from your IP address to pre-select your region); Section 7 describes them, and Section 7.3 explains how to turn them off or object. On perkupapp.com, analytics and the chat widget stay off for visitors in Canada until you activate them in the cookie banner. We send marketing to Canadian contacts on the basis of express consent or an existing business relationship as CASL provides, and we honor unsubscribe requests within 10 business days. Requests and complaints go to legal@perkupapp.com, which reaches the person in charge of the protection of personal information at PerkUp (Section 14); you may also complain to the Office of the Privacy Commissioner of Canada or, in Quebec, the Commission d’accès à l’information.

11.7. Australia. Where the Privacy Act 1988 applies, you may request access to and correction of your personal information and complain as Section 11.2 describes; if you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner. Personal information is held in the United States and disclosed to the overseas fulfillment regions in Section 10.1 as needed to deliver orders.

12. Children

The Services are for adults: you must be at least 18 years old, or the age of majority where you live if higher. Our website and Services are not directed to children, and we do not knowingly collect personal data from anyone under 18. We do not sell, or process for targeted advertising or profiling, the personal data of anyone we know or should know is under 18, and we offer no features designed to increase a minor’s engagement. Organizations are responsible for the rosters and program data they provide to us (for example, through HRIS synchronization). If you believe a child has provided us personal data, contact legal@perkupapp.com and we will delete it or ask the Organization that holds it to.

13. Changes to this policy

We may update this policy by publishing a new version at perkupapp.com/legal/privacy-policy. Every version states its effective date, and prior dated versions remain available at that address or on request to legal@perkupapp.com. For a change that materially and adversely affects your rights, we will give notice, by email to the address on your account or by prominent notice in the Platform, at least 30 days before it takes effect. If a change would apply to personal data we already hold in a materially different way, we will ask for your consent where the law requires it, and you can withdraw consent or close your account before the change takes effect. Changes apply prospectively from their stated effective date. We review this policy at least once every 12 months.
